Terms of Service

These terms govern your use of CAN Evidence. Please read them carefully before using the platform.

1. Acceptance of Terms

CAN Evidence (the "Service") is operated by CAN Mobilities, Inc., a Delaware corporation ("CAN Mobilities," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms of Service. If you do not agree, do not use the Service.

The Service is intended for use only by licensed healthcare professionals acting within their scope of practice.

2. Eligibility and Accounts

To use the Service you must be at least 18 years old, be a licensed healthcare professional in good standing, and have the authority to enter into these Terms. By using the Service you represent and warrant that you meet these requirements.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information, to keep it current, and to notify us promptly of any unauthorized use of your account.

3. Clinical Decision Support Only

The Service provides evidence-based information to support clinical decision-making. It does not practice medicine, does not provide medical advice to patients, and does not create a clinician-patient relationship.

All outputs are informational. You are solely responsible for evaluating the accuracy, completeness, and applicability of any information and for all clinical decisions you make.

4. No Patient Information

You agree not to enter protected health information (PHI) or any identifiable patient data into the Service. The Service is not configured for, and is not intended to store, identifiable patient records.

5. Acceptable Use

You agree not to misuse the Service, including by attempting to access it through unauthorized means, interfering with its operation, reverse engineering it, reselling or sublicensing access, using it to develop a competing product, or using it in violation of any applicable law or professional obligation.

6. Intellectual Property

The Service, including its software, content, design, and trademarks, is owned by CAN Mobilities, Inc. or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal professional use, subject to these Terms.

You retain ownership of the questions and other content you submit. You grant us a license to process that content as necessary to operate, secure, and improve the Service.

7. No Warranty

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. Outputs may be incomplete, outdated, or incorrect.

8. Limitation of Liability

To the maximum extent permitted by law, CAN Mobilities, Inc. and its officers, employees, and providers shall not be liable for any clinical decision, patient outcome, or for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total aggregate liability for any claim relating to the Service shall not exceed the amounts you paid us for the Service in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless CAN Mobilities, Inc. and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your clinical decisions, or your breach of these Terms.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or its users. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. You and CAN Mobilities, Inc. agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute arising out of or relating to these Terms or the Service, except where prohibited by applicable law.

12. Changes to These Terms

We may update these Terms from time to time. When the clinical-use disclaimer changes materially, you will be asked to review and accept the updated version before continuing to use the Service.
